FuncPDF User Agreement · Introduction

Before using FuncPDF (referring to the FuncPDF application and its related software, hereinafter referred to as FuncPDF), please read and fully understand all rights and restrictions stipulated in the "FuncPDF User Agreement" (hereinafter referred to as "this Agreement").

zhanhao liu (hereinafter referred to as the Developer or the Developer) has always respected and will strictly protect the legal rights of users (including user privacy, user data, etc.) from any infringement while using FuncPDF. This Agreement (including the Privacy Policy at the end of this document) is the final, complete, and exclusive agreement between the user (hereinafter referred to as the "User" or "You") and the Developer regarding matters related to FuncPDF.

The content of this Agreement also includes all relevant agreements, rules, and other content related to FuncPDF software and related services that the Developer has released and may continue to release in the future. Once formally released and delivered to the user through appropriate means (in-app announcement, system notification, etc.), the foregoing content shall constitute an integral part of this Agreement, and you shall comply with it equally.

This Agreement shall be legally binding on your use of FuncPDF. You promise and warrant that you have the right and capacity to enter into this Agreement. Your commencement of use of FuncPDF shall be deemed as your acceptance of this Agreement. Please carefully read and understand all terms herein, including the exemption and limitation clauses that limit the Developer's liability and the restriction on User's rights (minors should be accompanied by a legal guardian during review).

This Agreement includes the "FuncPDF Privacy Policy," which covers the collection, use, and protection of User's personal information and data. You confirm that accepting this Agreement signifies that you have fully read, understood, and agreed to all the content of this Agreement and its affiliated "FuncPDF Privacy Policy." If you cannot accept all the terms of this Agreement, please do not start using FuncPDF.

I: Account

You understand and promise that the account you set up must not violate national laws, regulations, and the Developer's relevant rules. Your account name, avatar, profile, and other registration information must not contain illegal or undesirable information. You must not open an account in the name of others without their permission, nor shall you maliciously register FuncPDF accounts. In the process of account registration and use, you must comply with relevant laws and regulations and must not carry out any acts that infringe upon national interests, harm the legitimate rights and interests of other citizens, or are harmful to social morals. The Developer has the right to review the registration information you submit.

You shall bear sole responsibility for the theft or loss of your account due to your own reasons or other unforeseen factors, and the Developer shall not bear any responsibility.

III: Restricted Terms

Your authorization under this Agreement shall be subject to the following restrictions:

You shall not license, sell, lease, transfer, distribute, or otherwise commercially exploit FuncPDF in any form;
Unless such restrictions are prohibited by law, you shall not modify, translate, adapt, merge, utilize, disassemble, reconfigure, or reverse compile or reverse engineer any part of FuncPDF or its derivative products;
You shall not use FuncPDF for the purpose of creating a same or competitive service;
Unless expressly provided by law, you shall not produce, copy, distribute, sell, download, or display any part of FuncPDF in any form or method;
You shall not delete or destroy any copyright notice or other proprietary markings contained in FuncPDF.

V: Paid Membership

Any updated version or future version, update, or other changes to FuncPDF shall be governed by this Agreement.

FuncPDF provides Paid Membership services to users.

Membership Types (taking the iOS platform as an example):

Please note:

Users need to pay according to the opening process and regulations for the in-app FuncPDF membership service, and the specific price varies by region. The membership service can only be used after successful activation. Users of Apple mobile phones purchase this service through Apple's in-app payment by paying a certain fee as agreed, aiming to provide additional PDF processing capabilities and advanced features.
The fee for the FuncPDF membership service shall be subject to the price displayed on the membership service page at the time you open the service. The Developer has the right to decide to modify the membership fees at any time. Any changes to the membership fees shall take effect at the end of the current billing cycle. After purchasing the membership, you can see the membership expiration date on the "My" page of the App.
The valid service period you obtain shall be determined by the period you independently choose and pay the corresponding service fee for. After the valid period expires, the exclusive membership benefits will be automatically canceled.
The FuncPDF membership service includes all membership rights and features upon purchase, therefore, no refund will be given for paid amounts. You may stop renewing after the current membership period expires. The price you pay includes local taxes. The service cannot be transferred after being activated; the paid fees are non-refundable regardless of whether you actually use the service or access the digital content during the corresponding service period.
For Subscription Services: Upon confirmation of purchase, payment will be charged directly to your iTunes account. After purchase or trial, renewal will proceed automatically. The Apple iTunes account will be charged within 24 hours before the expiration date, and upon successful charging, the subscription period will be extended for one subscription cycle. You can modify the automatic subscription settings in your system account settings. To cancel the renewal, please do so at least 24 hours before the current billing period. Please note that the cancellation of renewal must be manually completed in your Apple iTunes account settings; the FuncPDF application itself has no authority to directly cancel the renewal for you.

VI: Compliance with Laws

You agree to comply with any and all provisions of relevant Chinese laws and regulations, including but not limited to the "Contract Law of the People's Republic of China" and the "Copyright Law of the People's Republic of China" and its implementation regulations. You shall bear full responsibility for any actions and their consequences resulting from the use of this service with your password and account. Under any circumstances, if the Developer has reason to believe that any of your actions, including but not limited to your comments and other behavior, violate or may violate any of the aforementioned laws and regulations, the Developer may terminate the provision of services to you at any time without any prior notice.

VII: User Content

User Content refers to all content generated by the user when downloading, posting, or otherwise using FuncPDF (e.g., your information, pictures, PDF files, processed documents, or other content).
You are solely responsible for your User Content, and you shall bear the risk of you or any third party being identified due to the disclosure of your User Content.
You agree that your User Content is subject to rights restrictions (see "VIII: Rights Restrictions"). You acknowledge and agree that, in order to realize the PDF processing function of FuncPDF, optimize App experience, measure advertising effectiveness, and other purposes, you grant the Developer a limited, non-exclusive, transferable, royalty-free right to process and store your files to the extent necessary for providing the service, as well as the collection and use of your device and usage information (details are in the "FuncPDF Privacy Policy").

VIII: Rights Restrictions

You agree to use the relevant services in FuncPDF through sharing or other means, and in the process of use, you shall bear all legal liabilities arising from the risks caused by the following actions:

Violation of the basic principles established by the Constitution;
Endangering national security, leaking state secrets, subverting state power, or undermining national unity;
Harming national honor and interests;
Inciting ethnic hatred, ethnic discrimination, or undermining ethnic solidarity;
Destroying the state's religious policy, or propagating cults and feudal superstitions;
Spreading obscenity, pornography, gambling, violence, murder, terror, or inciting crime;
Insulting or slandering others, or infringing upon the legitimate rights and interests of others;
Containing other content prohibited by laws and administrative regulations.

You agree not to engage in the following acts in FuncPDF:

Posting or sharing computer viruses, worms, malicious code, or software that intentionally damages or alters computer systems or data;
Collecting information or data of other users without authorization, such as email addresses;
Maliciously using FuncPDF in an automated manner, causing an excessive burden on the server or otherwise interfering with or damaging the network links;
Attempting to access FuncPDF's server data or communication data without authorization;
Interfering with or disrupting the use of FuncPDF by other users.

IX: Intellectual Property Rights

FuncPDF Application Ownership: All intellectual property rights, including copyrights, trademark rights, patent rights, and trade secrets of the FuncPDF application, as well as all information content related to the application (including but not limited to text, images, audio, video, charts, interface design, layout framework, data, or electronic documents, etc.) are enjoyed by the Developer (zhanhao liu) in accordance with the law or have obtained legal authorization.
User Content Ownership: The intellectual property rights of any PDF files, data, or content that you upload, create, edit, or process through FuncPDF shall remain owned by you or the original rights holder.
Commitment: The Developer commits not to use your files for any purpose other than providing the service.

X: Modification and Termination

Modification

This Agreement is subject to change. If there are any material changes to this Agreement, we will notify you via email or in-app notification. By continuing to use FuncPDF after the notification of changes, you acknowledge such changes and agree to be bound by the terms. The Developer reserves the right to modify, retain, or close any service of FuncPDF at any time without notice. You agree that the Developer shall not be liable to you or any third party for modifying, retaining, or closing any service of FuncPDF.

Termination

This Agreement shall be effective from the date of your acceptance and shall remain in full force and effect during your use of FuncPDF until terminated in accordance with this Agreement;
With or without notice, the Developer may terminate this Agreement at any time for any reason, including the good faith belief that you have violated our acceptable use policy or other provisions of this Agreement;
Upon termination of this Agreement, your right to use FuncPDF shall cease. You should be aware that the termination of your product means your User Content will be deleted from our active database. The Developer shall not be liable to you for terminating this Agreement, including terminating your User Account and deleting your User Content.

XI: Third Party

You acknowledge and agree that some of our services are obtained based on third-party technical support, including but not limited to providing advertising and analytics services. You acknowledge that this Agreement is entered into between you and the Developer, not between you and the aforementioned third parties. The Developer is solely responsible for the content generated by FuncPDF, maintenance, support services, warranties, and lawsuits arising therefrom. You agree to abide by and authorize FuncPDF to restrict your conditional use of FuncPDF services.

XII: Third-Party Information and Services

FuncPDF contains certain information and services from third parties, including third-party advertising content. The Developer does not control and is not responsible for the information and services (including advertising) of third parties;
The Developer provides such information and services only for your convenience or to fulfill the need to promise and guarantee third parties;
Users shall bear legal liability for the risks arising from the use of third-party information and services. Please note that when you interact with third-party services (including advertising), your data may be shared with the third party according to the "FuncPDF Privacy Policy," and the terms and policies of that third party shall apply.

XIII: Indemnification

You agree to use FuncPDF harmlessly and indemnify the Developer against any complaints, lawsuits, losses, damages, liabilities, costs, and expenses (including attorneys' fees) from third parties arising from the following actions or related actions:

Your use of FuncPDF;
Your User Content;
Your violation of this Agreement.

The Developer reserves the exclusive right of defense and the right to claim compensation.

In no event shall FuncPDF be liable to you or any third party for any indirect, consequential, punitive, incidental, special, or punitive damages arising out of this Agreement. The risk of damaging computer systems or mobile communication device data arising from accessing or using FuncPDF shall be borne by you personally.
